Apple Challenges EU’s Landmark USD587M Fine
The fine, announced in April, stems from the EU’s groundbreaking DMA regulation designed to ensure fair competition and expand consumer choice within digital marketplaces. Apple was found guilty of limiting app developers from guiding users toward cheaper deals outside the App Store, a tactic referred to as “steering.”
This case represents one of the initial major enforcement moves under the DMA framework. According to the European Commission, Apple’s restrictions blocked developers from fully capitalizing on alternative sales channels, thereby restricting consumers’ access to more affordable options.
“Today we filed our appeal because we believe the European Commission's decision – and their unprecedented fine – go far beyond what the law requires,” Apple stated in its announcement of the appeal to the general court, which ranks as the EU’s second-highest judicial body.
Apple further argued that the European Commission is “mandating how we run our store and forcing business terms which are confusing for developers and bad for users.”
The tech giant also criticized the EU regulator for expanding the concept of “steering” to encompass not only external link restrictions but also in-app advertisements and alternative payment methods.
